Inquiry: Last night i was surpised to look in my rear view mirror to see bright cherries had lit up the behind me. I was being pulled over, the officer had taken my documents as well as old drivers licence i had left in my wallet. Upon returning with my documents he stated he was charging me with speeding 75 in a 50. I was quite shocked, as I was sure I was only at 58 bordering 60. Being nervous I never thought to ask to see his radar. Nor was I given the opportunity to even asked as he was very brief. Just wondering if i should have been given the opportunity to see the radar, and how accurate is the radar, is there any room for error with todays radar. I am thinking of submitting a not guilty plea, however wondering the consequences of doing so. Thank you.
Response: You can always ask an Officer to see the radar, however if they decline to show it to you then you can not press the issue as they have no legal obligation. At 25 km/h over the speed limit, the charge is a 3 demerit point offence. We can usually get a 25 km/h over the speed limit charge down to a lesser 0 demerit point offence, and in some cases can have the charge eliminated completely.
