Inquiry: I had entered an intersection on a green advance arrow, but could not clear the intersection. I waited until the through traffic had a yellow and tired to clear the intersection. I was struck in the rear passenger side door. Witness stated to me and the police that the car run the red light and has been charge as such. I’m being charged $100 and three demerits – haven’t recieved the ticket as of yet but I believe that it is for a unsafe turn. If the other driver is charged with running the light, are the not at fault? I’d appreciate any help on the matter.

Response: Both parties may be at fault. You are allowed to complete a turn if you have entered the intersection on a green light, but must do so in a safe manner. Regardless, it may be possible to defend the charge at Court. If you would like to persue the matter, you can contact one of our staff via our toll-free number 1-866-801-8299.
