Inquiry:  On July 2 2012 i was pulled over by police in the city of Niagara Falls Ontario. I was told by the officer that i was pulled over for driving too slow as we were lost and looking for our hotel. The officer asked for my licence, registration and insurance and after quite awhile returned asked me to step out of my vehicle and informed me that my licence had been suspended. I was not aware of this. I returned home to Stratford on July 4 and on July 5 i received a notice of suspension in the mail for an unpaid ticket. The suspension took affect on Friday June 29.My question is since i had no way of knowing my licence had been suspended do i have a defence?

Response:  Possibly.  We would need to get a disclosure of evidence from the Crown’s office and review the matter with the Prosecutor to see whether the charge could be withdrawn, reduced, or would need to be resolved by trial.  A DRIVE UNDER SUSPENSION charge carries a total payable fine up to $6,250.00, a mandatory 6 month suspension of licence, and possible jail time.  If you would like to discuss your case, we offer a no-cost initial review of matters via our toll-free number 1-866-801-8299.
