Inquiry: I was ticketed for drive under suspension in December despite having never been pulled over. I was unaware that I was even driving without a licence. The officer claimed to have seen me driving (it’s a very small town) and gave me a ticket over a week after the alleged incident. I know I wasn’t driving at the time because I had been warned previously regarding an expired validation sticker, and kept the vehicle parked after the warning. Do I have a case? Response: A Drive Under Suspension charge is a very serious offence carrying a total maximum fine of $6,250, up to 6 months jail, and a mandatory 6 month suspension of licence upon conviction. Without identification of the vehicle’s driver at the time of the alleged offence, it may be difficult for the Prosecutor to gain a conviction at Court. However, the evidence being brought forth against you will be more clear once we have received disclosure from the Prosecutor’s Office.
