Inquiry: On August 13 2011, I was charged with fail to yield from driveway 159(1) – this involved a pedestrian who walked behind my vehicle – witness said she did so but the officer still charged me – she cut her leg on her walker and fell to the ground but was not touched by the vehicle. He informed me it would cost me 6 points and $110 fine. If I pay this fine how many points will I lose, and is there any way to fight this as she later admitted to her son that she walked into my vehicle and does not want me charged.
Response: The charge should carry 3, not 6, demerit points. Given that a pedestrian was struck in your case, I would recommend discussing the details of your case directly with one of our staff via our toll-free number 1-866-801-8299.
