Inquiry: My son was charged for lane change not in safety after signaling. After successfully making the lane change, the light turned yellow so he stopped and the car behind did not stop in time and hit our vehicle in the rear bumper. As no one was hurt but damages seemed to be in excess of $1000, they went to the police station, filed reports and to our surprise he was charged. He thinks he will plead not guilty. Based on your expereince, will this charge be dismissed or upheld? Should he meet with the prosecutor or go straight to court. He is a G2 and this would be his first charge (2 demerits).
Response: Without seeing the Prosecutor’s evidence it is difficult to predict whether the case against your son is a strong or weak one. If your son is going to contest the charge, he will likely want to obtain legal representation as the matter will likely be a trial issue. While the responsibility to change lanes in a safe manner is upon your son, he may well have a defense to the charge.
