Inquiry: I turned left at an intersection on a yellow, a driver oncoming appeared to be speeding and hit me. I was charged with unsafe to turn. Is there a lesser charge if I wanted to fight it on the basis it was safe to turn but the other driver was speeding or perhaps even ran a red? Alternatively could I face a worse charge if I fought it in court? Thanks,
Response: From the brief description that you have provided, your charge will likely be an all-or-nothing outcome at Court; either the charge will be thrown out, or it will stand as issued. In very exceptional and rare cases, it is possible that the original charge may not be proceed with and a different charge served. You may have a valid defense to the charge. If you would like to discuss your case in more detail, I would recommend speaking with one of our staff via our toll-free number 1-866-801-8299 for a no cost initial consulation.
