Inquiry: Hi there, if I’ve received a speeding ticket for 26km over the limit, and decide to go through trial option, how low could the Crown reduce the charge to? I’m hoping for just 15 over and 0 points, is that realistically possible?
Reponse: It will depend upon the Prosecutor and the Court that you are dealing with, as well as your driving history and the strength/weakness of the case against you. The first step in every case is to review a disclosure of the evidence against the Defendant to determine whether or not there is a grounds to have the charge(s) dropped. Only after determining that the Prosecutor actually has a reasonable prospect of winning the case do we look at negotiating to lesser offences. Unfortunately as a non-represented Defendant, you will be at a disadvantage in that process without a knowledge of the law or the ability to effectively argue in the courtroom.
