Inquiry:   Was stopped for speeding. 73km/h in a 50km/h zone. Was provided with a hand written ticket and the officer did not include my DL# on the ticket. Am I able to challenge the the facial validity of the ticket and if so, have the ticket and offense thrown out as aresult of missed information at the time of it being issued?

Response:  We can definitely challenge the identification issue at Court.  It will be up to the presiding Justice Of The Peace to weigh out the argument to determine whether the charge would be dismissed on that grounds or not.  At 23 km/h over the speed limit, the charge carries 3 demerit points.  If the charge can not be dismissed, it is possible that it may be reduced to a lesser 0 demerit point offence.  If you would like to retain our services in defending against the charge, our staff may be contacted via our toll-free number 1-866-801-8299.
