Inquiry: I was with my bf in his company van. A cop pulled up beside us. Neither of us wearing seatbelts. Bf was using his work gone on speaker. Cop pulled us over and gave him 2 tickets. One for using a hand held on speaker phone. The other for his seatbelt. Strangely enough I didn’t get one for by wearing mine. Anyways, why is it that a taxi cab can still use a hand held speaking device and not get a ticket for that? Second question, the officer forgot to write in the day of the month the ticket is being issued. It says June 2012. At the bottom of the ticket he certifies it under a date. Can this ticket be void if he doesn’t write in the date of the occurrence?
Response: We would have to look at the dating issue in more detail to see whether it will be any problem to the prosecution of the case. In cases of multiple charges, it may be possible to negotiate having one charge withdrawn. Whether or not there is a grounds to have both charges thrown out at court, we would need to wait until we have had a full disclosure of evidence from the Prosecutor’s Office. If your boyfriend would like to have us contest the charges, we offer a no-cost initial consultation via our toll-free number 1-866-801-8299.
