Inquiry: Recently, I was driving on an interstate highway when up ahead, an officer had someone pulled over on the right-hand shoulder. The other drivers moved over into the left-hand lane. Because of the traffic passing me in that lane, I was unable to get over, so I slowed down significantly.
After passing the officer, he pulled me over and gave me a ticket for “failure to vacate lane or slow down for emergency vehicle”. He said the speed limit was 65 and that he clocked me doing 60. He said that I was required to reduced my speed by 20mph below the speed limit.
Though I can’t recall what my actual speed was, I am certain I slowed well below 60mph. However, I noticed on my ticket, there is nothing listed for my alleged speed. The officer left this space blank. Should I fight this?
Response: The Officer will likely have documented any speed estimation in his roadside notes. Whether or not the Prosecutor will have a strong or weak case in your matter, we will not know until we have had a release of evidence to review.
