Inquiry: Hello. I just got my first ticket 🙁 i was pulled-over because I had a head light out which was a surprise to me (I’ll get it fixed right away). I gave the officer an expired insurance slip and got a ticket for $65.00 for that. I had two separate pockets in my glove box. One (which I gave the officer) with my expired insurance slip and owners slip and one with the new unexpired insurance slip. I couldn’t find it in my messy glove box at the time and wasn’t 100% if I had actually put the new one in there or not. I was sure I did but the longer I looked the more I doubted myself. I did find it once I got home and ripped apart the whole glove box. It was stuck in-between other crap. I been looking online about how tickets are seen as tickets to insurance companies and its a good idea to fight any ticket if you have a chance. My question for you, do I have a chance? If I go to court and take the proper paperwork and explain that it was in the car, I just couldn’t find it at the time. I was really nervous and not in my best thinking mind at the time because of those freaky flashing lights. If I decide to go to court will the officer have to come? I don’t want to bother him with this (he did give me a lesser fine of the two). It’s only 65.00 but I don’t want anything on my record if i can prevent it. Any advice?
Response: Providing the insurance card after the fact is unfortunately not a defence to having not surrendered it to the Officer when asked to do so. However, on some occassions the Prosecutor may agree to withdraw the charge if provided proof. You may attempt to resolve the charge with the Prosecutor on your own, or hire a paralegal to present that argument on your behalf.
