Inquiry: Hi I was reviewing my ticket before going to court next month…I noticed that I was charged for Disobeying stop sign-fail to stop however the Highway traffic act quote is 136(1)(d) there is no (d) in the act could that help me in court or not…according to the act it only lists (a)(b)…just thought it was worth a shot to ask here.
Response: It is very likely that what you are interpreting as a “d” is an “a,” which is the correct section of the HTA for a Disobey Stop Sign charge. In specific cases, if the section number that a Defendant is charged under is incorrect, there is a good chance to have the charge dismissed. In this case, debating the length of the line on the right side of the letter would not likely be a strong argument.
